I have been following this bill closely and I must say I have mixed feelings on it. I have actually read the bill and it refers only to licensed breeders. A licensed breeder is one who sells retail or is a broker or sells for science. We are talking large operations here.

It is my understanding the real fear is if a new bill is proposed above and beyond this for the hobby breeder. This has yet to be seen however.

I own a breed of dog that is frequently fighting bsl issues. This is my concern if there is no regulation on the large operations then there are more chances of poor examples ruining the reputation of our breed. As far as Im concerned the less puppies out there the better. I do not think I own a breed for everyone, especially someone walking into a pet shop that hasnt a clue other than the puppy is cute. This is scary to me and why I have reservations and conflicts with this bill. Granted if it went one step further I would fight it will all my heart. I just am having a hard time with this bill. Curious if anyone out there has put an effort forth to fight it personally?

Just to clarify as it seems some misunderstanding is going around after reading the AKC site. This is not for the HOBBY BREEDER. They will not be coming to your home. They are more concerned with the licensed breeder with 100+ breeding dogs. Lets not forget that most of the puppies coming from these large operations will be AKC registered. Take what they say on their website with a grain of salt. Read the actual bill.

If the goal is not to regulate breeders other than the liscenced kennels, why does the bil not state that it only applies to liscenced breeders? Why do we need this bill at all, the liscenced breeders are already liscenced by the USDA and are inspected by the USDA. What does this new law give the USDA that they don't already have. The AKC will never make any real moves to help any of the breeds. However they will work to attempt to protect the ability to maintain breeding for dogs.

The AKC is not the only organization against this bill. I have yet to see a single organization that is involved with dogs that supports this bill. None. If you know of any I would be willing to look at what they have to say.

If this bill is so good why was it passed without debate, without a reading of the bill, with out the full bill even being published at the time of the vote? If you want further regulation on the commercial trade, why not say that in the bill?

Excellent posts Richard. People need to understand that ANY bill backed by PETA must be suspect. Also I believe it was last year that the Doris Day Animal League (DDAL) won an appeal against the USDA that will force the USDA to regulate ALL sellers of puppies whether wholesale (Puppy Mills) or retail (all the rest). So, if this appeal stands then ALL breeders will have to be licensed by the USDA and then we will ALL fall under any laws that may now only apply to puppy mills. In the end it will be far too expensive for the good breeders to breed so all we will have will be the large commercial breeders and then they will figure out another way to get them...... We must not allow these AR to get their foot in the door.

It does state it is only for licensed breeders, they just have left that part out where ever you are reading it.

Here is who it applies to:

(a)(1) Any person operating or desiring to operate as a dealer, exhibitor, or operator of an auction sale, except persons who are exempted from the licensing requirements under paragraph (a)(3) of this section,

(3) The following persons are exempt from the licensing
requirements
under section 2 or section 3 of the Act:

(i) Retail pet stores which sell nondangerous, pet-type animals,
such as dogs, cats, birds, rabbits, hamsters, guinea pigs, gophers,
domestic ferrets, chinchilla, rats, and mice, for pets, at retail only:
Provided, That, Anyone wholesaling any animals, selling any animals for
research or exhibition, or selling any wild, exotic, or nonpet animals
retail, must have a license;

(ii) Any person who sells or negotiates the sale or purchase of any animal except wild or exotic animals, dogs, or cats, and who derives no more than $500 gross income from the sale of such animals to a research facility, an exhibitor, a dealer, or a pet store during any calendar
year and is not otherwise required to obtain a license;

(iii) Any person who maintains a total of three (3) or fewer breeding female dogs and/or cats and who sells only the offspring of these dogs or cats, which were born and raised on his or her premises, for pets or exhibition, and is not otherwise required to obtain a
license;

(iv) Any person who sells fewer than 25 dogs and/or cats per year which were born and raised on his or her premises, for research,
teaching, or testing purposes or to any research facility and is not otherwise required to obtain a license. The sale of any dog or cat not
born and raised on the premises for research purposes requires a license;

(v) Any person who arranges for transportation or transports
animals solely for the purpose of breeding, exhibiting in purebred shows,
boarding (not in association with commercial transportation), grooming,
or medical treatment, and is not otherwise required to obtain a
license;

(vi) Any person who buys, sells, transports, or negotiates the
sale, purchase, or transportation of any animals used only for the purposes
of food or fiber (including fur);

THIS IS THE MOST IMPORTANT ONE AND KNOCKS OUT MOST INDIVIDUALS

(vii) Any person who breeds and raises domestic pet animals for
direct retail sales to another person for the buyer's own use and who
buys no animals for resale and who sells no animals to a research
facility, an exhibitor, a dealer, or a pet store (e.g., a purebred dog
or cat fancier) and is not otherwise required to obtain a license;

(viii) Any person who buys animals solely for his or her own use or
enjoyment and does not sell or exhibit animals, or is not otherwise
required to obtain a license;

The doris day act is in regard to class b dealers. It has not yet been passed.

Class ``B'' licensee means a person subject to the licensing
requirements under part 2 and meeting the definition of a ``dealer''
(Sec. 1.1), and whose business includes the purchase and/or resale of
any animal. This term includes brokers, and operators of an auction
sale, as such individuals negotiate or arrange for the purchase, sale,
or transport of animals in commerce. Such individuals do not usually
take actual physical possession or control of the animals, and do not
usually hold animals in any facilities. A class ``B'' licensee may also
exhibit animals as a minor part of the business.

Remember anyone who shows their dogs or performs in a dog sport or even just does public demonstrations (i.e. fund raising for police K9 using privately owned dogs)is considered a "Exhibitor". More reason to oppose this bill. This applies to everyone who has animals that wants more from them than just a simple housepet.

As I THINK I stated before I am very involved with BSL issues. However, I am not one of those individuals that just takes anothers word for things as sometimes simple issues seem to run rampant. As in this case. I do however, hope I was able to clarify the true issues at hand in this act.
