I could never condone telling someone to get a dog that they know won't work for them. I would also say that any breeder who won't take a dog back for any reason after 48 hrs (my contract states 2 weeks at full price, state law is 3 days on contracts) deserves to have his name and business dragged through the mud. He seems to think highly of his product but not highly enough to simply find a new owner for it or properly screen potential owners. He's taking this guy for a ride, IMO from the view on this side.

To me this is a simple case of I returned the X which was not what was advertised/expected, there was no transfer of registration, and the guy wouldn't give me my money back. The state of California in most cases frowns upon this kind of thing and I suspect 3 days is the state law there on contracts over a certain dollar amount.

We can choose to harp on Greg about not giving a puppy a chance but IMO it's wise to come to the conclusion this isn't what I wanted sooner rather than later and take action. He tried to return his puppy to the breeder (which really is a good thing) but the breeder wanted to wash his hands of the puppy (which is never a good sign). I think small claims is where this is headed and I would not encourage him to do anything to complicate an already muddy transaction.

You mentioned you have a friend that would take the dog? Do you mean he wants the dog? Or would consent to taking the dog off your hands?

You said the dog was bumping into walls and fences. Is that literally bumping into things? Or do you mean the dog was trying to climb the walls, mmmmm rephrasing, perhaps running around bouncing off the walls as in releasing energy?

That you weren't prepared for a working line dog certainly does reflect badly on the breeder. Maybe you can get your money back, given enough time invested in the endeavor.
But I know in this part of the world the dog would be old enough to be the dog you always dreamed about before you'd see your money again.

Mind if I ask what kind of activity level did you expect to put into your calm laid back pup?

I have to wonder from what the OP posts if this breeder/trainer does this on purpose.

One of the puppy books I read last year had an example in it of a breeder who intentionally sold puppies with lots of drive and questionable temperament to pet homes. Then they would take the dogs back as young adults when they were too much to handle, train them and resell them as "guard" dogs.

I would take them to court. First it sounds like you have done everything you can to try and help the situation. Plus you returned the pup immediately. Even if you made a mistake by getting a pup, since you took action to reurn the pup right away you should at least get some of your money back.

Its not your fault. Even if you made a mistake by getting a puppy, its the breeders job to properly screen puppy homes. My breeder interviewed me for over an hour asking me every question imaginable before she even considered matching me with a pup. Thats what a good breeder does.

my neighbor has a 4 months german show line pup,playful as a normal puppy and would calmly lay down near his owner chair with a toy when we were at their house.

When I visited FALCONER'S KENNEL. We didn't see the whole litter,Bryan took this 8 week old female priced at 1250 and willingly to sell me for 1150. We were there for 2 hours asking questions and carefully screening puppy's behavior. She just walking in her play-pan and would lay down with a toy then fall asleep. We ask the breeder where are the parent ? he said the Sire was sold last week for $8000 and the dam is one of his client's dog. and we ask how's the puppy actively level. he said as you can see she is sweet and mellow. That's why we got her,after we paid breeder told us he didn't have the shot record,AKC paper in hand,since the co-owner took the suitcase with him. I didn't think much but my wife kind of unhappy. But they have the money and I like the puppy so I asked my wife to trust them for they are police k-9 trainer.

Puppy was being a puppy the first day.2nd day I took her to potty she ran with a full speed and bump her heard to the fence and again then again like a crazy person....
My wife sense something is not right,she said:
"Maybe she is not a pet quality ? Maybe she is a working puppy ? I think the breeder mistaken the showline pup and a working line pup. It's okay Bryan seems sweet ,let ring him up...."

then they refuse to take our calls......and puppy continusly acting crazy for the following hours ......

I will not take this dog back since I have never ask for working dog. Plus this is not about the money any more. We would like some justics on this type of breeder.

We asked for the money back because we will not let the Falconers make money from us. I do not want to give them business at all.

Bryan Falconer yelled at my wife when my wife ask him why would he sold us a pup with high drive. He lies and said" no you did not ask for showline,you did not ask for a calm puppy, you spent 2 long hours at my place,no one has took this long to make a purchase."

Eric Falconer the owner told my wife over hte phone" I remember this puppy is a runt." and my wife said" I don't want a runt puppy,I asked for etc,,,"

then Bryan took the phone say screaming again" The puppy is not a runt,why you said that.."

It was a very bad experience when they are changing stories.
When I email them about returning the pup within 2 days. They replied my email like this " Hi greg,we are glad you love the puppy, we will overnight the shot record and AKC paper to you."
We were like ????????????????? are they also crazy too ????

We are trying to make appintment with a court advisor now,
It's not about the money when dealing with someone who just want to take everything from you. I don't think it's okay for them to yelled at my wife,hung up on me. demanding us around to post ad,to have friend pick up the dog,charging fees however they like to. when we refuse to pay them more money they said" OHHH I AM SORRY YOU HAVE FINANCIAL PROBLEM. YOUR FINANCAI BASE IS UNLIKE OUR OTHER CLIENTS...."
Now they demanding us to pick up the dog in 72 hours or they will keep the dog.
I really don't trust them on this. Will they really let us walk away with this puppy like this ???
what if we got there (2.5 hour drive)they wont open the gate ?
what if they ask us to pay or leave emply handed ????

My wife working from home. She jogs in the morning and walks around neghborhood in the afternoon...
We have 7000sq ft yard for the dog to play while my wife is working on her laptop out door.

We have purchased Leerbugs training DVDs. and are planing to do as it said.

SO NOW.....WE WILL NOT TAKE A RISK OF GETTING A UNPREDITABLE DOG. IT'S NOT ABOUT MONEY,IT'S NOT ABOUT SAVING PUPPY. WE FELT LIKE IT WAS A SCAM,LANGUAGE ABUSE AND BREACH OF CONTRACT.
