The poor dog obviously wasn't a bully breed or the article would have probably said it was a pit bull in the first sentence or two. Regardless of the breed, did the officers even have a right to open the door in the first place? The article made no mention of a warrant or anything, but wouldn't they have needed one in order to open the door and enter the home without Ross letting them in?

If they had a search warrant they had a right. Doesn't sound like they had probable cause, but they're not giving out the whole story. I don't buy the story that he didn't hear the police knocking. He should have just opened the door instead of playing the rebel and his dog would be alive.
Something similar happened in California and the people who owned the dogs shot by LEO's sued and won. They were real criminals compared to the guy in the article, but the courts still found in favor of them.
Its easy to second guess the police when all the facts are not there. I know for a fact that the vast majority of investigative news articles are always full of errors, mis-quotes, lies and omissions. If a person wasn't there to witness the incident then it is only speculation on what may have actually occurred.
The owner was cited once before and told not to work on the house thus the trespasing. With that ad that alone it gave to the police the right to enter the house. The dog rushing was shot to for officer safety. I my self have shot dogs before on Search warrants and other calls. I don't know the dog and he does not know me BUT when on officer is doing his job and the animal gets in the way or tries to attack the officer measures have to be taken. Like Howard said it is easy to pick the police apart and say what you want but the fact remains the police had to protect themselves. I would have done the same thing.
