Most animal shelters have a rule that an animal picked up as a stray must be spayed/neutered before being adopted. However few places insist that a dog being reclaimed by it's owner must be altered. Almost everywhere I've checked makes exceptions for working, show, or hunting dogs. I'm really surprised at hearing this. Makes me wonder if the shelter didn't already neuter the dog before it's time was even up and they're trying to cover it up.

It's ridiculous, but this article doesn't state WHY this guy is so hell-bent on keeping the dog intact.
I know, we should all have the right to do whatever we want with our dogs' reproductive organs, and I don't support this shelter's rule (and I bet Janice is on to something with the cover-up theory) -- but if it was me, and I didn't have a reason to keep my dog intact, I'd let them neuter the damn thing as opposed to euth it.
Could the town or county this dog got loose in have a mandatory spay/neuter law? That could be a fly in the ointment here. The dog did not get loose at home, he was at a friend's.

A quick Google search reveals this law that apparently has passed in NY:
"The language of the bill is as follows: No animal shelter, pound, animal control officer, humane society, dog or cat protective association or duly incorporated society for the prevention of cruelty to animals shall release any dog or cat for adoption to any person unless prior thereto the dog or cat has been spayed or neutered."

I can't find anything NYC/Queens specific, unfortunately. I think the issue with this case is defining "release for adoption". This guy isn't adopting... he's getting his dog back. Unless NYC has a more specific rule, it seems like he should get his dog back in one piece.

The owner states as described by the article:
He (the owner of the dog) argued that neutering would hurt Spartacus' health, sap him of stamina needed to keep up with the horses and steer on the farm, and prevent him from breeding.

Indeed. Unfortunately, I don't think there is another "holding facility" for loose animals that are collected by the city OTHER than the shelter, which obviously adheres to very strict policy on this subject (I'm speaking of cities and towns generally). Doesn't seem right that accidentally (and in this case it sounds like only very BRIEFLY) run-away pets should be thrown into the "homeless animal" system, just becuase there is no other place they can wait for thier owners to retreive them...
I'm glad someone picked up this big boy, as he may have looked a little spooky running the streets on his own, though a healthy dog who was probably wearing some sort of collar (even without ID) should be given at least a few days for his owner's to come before being subjected to the protocol of being made "adoption ready". And not to say they DIDN'T already do the surgery (as was suggested), but don't they usually put off such an expense until they find the critter a home? Wouldn't want to waste time and money on ALL those surgeries when so many are sadly put down anyway.
I feel for this guy and I'd fight it too.

This thing is really chapping my hide, so I googled cane corso & emailed a letter with the link to as many east coast cane corso breeders & associations as I could find. WAAAAYY to much time on my hands today!

If this dog was a valuable champion G.S Breeding Dog would any on this forum think it right to be neutered, I think not. No one city or council has the right to tell or pursue this course. If it is a Stray then that is another thing, the owner has explained how his dog escaped and he should be the only one to decide if the dog should remain an entire dog, not some stupid burocrats who would probably gain more sense if they themselves was given a snip
