Well I hope this is the right fit for this topic. So many apartments have what you all probably know as vicious breed clauses where they lump Dalmatians, rots, and pit bulls as vicious. Where it gets tricky is my sister is wanting to use my Pit bull who is a gentle dog who could nearly pass a canine good citizen with little extra training. I know many a pit bull has been a therapy dog and that isn't my question. My question is in regards to law; is there a law that would protect her and the dog.
Meaning can a license or certified service/therapy dog trump a dog clause in the apartment?
If so could you give me the specific law rather than I think you can as this would help out tremendously.

Service dog yes, I don't have the particulars, AWDA covers alot of that. I think Therapy dog is still being argued. A service dog, well, has to preform a service IE guide dog for the blind, seizure alert dog etc. The therapy dog, I dunno, "I feel much better and more secure when I pet my well behaved dog" well, so do I but I can't take her everywhere.

Does your sister have a medical condition where she could use a service dog? Or does she just want to be able to have the dog in the apartment with her?

I beleive certified service dogs are, by law allowed, anywhere.
A nearly ready for an AKC CGC or an aready awarded CGC title for that matter doesn't even come close to what a service dog is or does.
Find out if your sisters landlord has any restrictions on breeds. If so, by the time you train the dog to any service work at all and get certification, the land lord will be dead or your sister will have moved.

I think the cert for service dog is pretty loose and vague, I'm sure if I could convince my Dr that my back was bad enough that I couldn't bend over and I trained Erika to pick up stuff for me and get essential items, in my case beer and the TV remote, then all I need is a Dr's script and a service dog vest. BUT the Erika's behaviour in public has to be impeccable, if she is noisey, dirty, aggressive or just bouncing all over then the establishment can tell me to leave.

A service dog has to be trained for specific tasks that help a disabled person. I'm almost sure that by law the landlord has to allow a service dog. But your sister would have to be disabled in some way to have a service dog, and the dog should really be with her 99% of the time.
There are certifications for service dogs, but as far as I know they aren't required by law.
Therapy dog certification or a CGC may help sway a landlord who isn't fond of the idea of having a dog, but the landlord still doesn't have to allow the dog.

Do you research deeply into this, including current laws in your area. I looked into setting up a business here in NZ providing service dogs bespoke to individuals needs. However a loophole in law has prevented me from being able to label any of my dogs as service dogs. Why? Because there are only 3 'official' organisations who are allowed under law to call themselves service dog providers.
Thus in order for me to set up my business I would have to change law. Reality of me doing this? Low...

A service dog as defined by the ADA is allowed anywhere, regardless of breed. And Lauren is right; your sister would have to have a documented disability and a letter from a doctor stating that she needs the dog.
There is no recognized, legal certification, but the dog should at least have a CGC and have passed a public access test administered by a professional trainer. It MUST be trained to perform specific tasks to aid the handler in order to be considered a service dog.
Emotional support animals (I believe) are also allowed for disabled tenants. They are essentially well-mannered pets with no task-training, kind of like therapy dogs, but for a specific individual. They are not allowed public access.
Both of the above are expected to be well-behaved, non-destructive and non-threatening or the landlord can revoke permission.
Therapy dogs aren't protected under federal law and so are generally not given any special consideration when renting. Some landlords will cut you a break, but in my experience it's been rare.
