To complicate matters more, the pup's brother also retained a testicle.... but it dropped after the pup was 5 months. The looser vet assures me that this is impossible.
I'm afraid that I don't have any legal advice for you but when I adopted my Border Collie/Husky mix he had a retained testicle at 5 months of age. When I took him in to be neutered at 6 months, it had dropped. It may be rare but it is NOT impossible!
I would be so ticked off. If you need some support in studies/paperwork for your 'arguement' there is some out there. I have a bit of it saved on computer. I am so tired of vets/rescue/spca etc advocating for early spay/nueter! It is not in the dogs best health interest!
When he objects to that, tell him he may contact you ONLY through your attorney -- Find out what organization oversees Vets in your state & file a COMPLAINT in writing with them today -- Call every TV station & newspaper in town & tell your story to them!
sorry--i just have to check in here. IMO, it was no "mistake" your dog was neutered. at best, it could be called "poor communication", at worst, well, i don't know what to call it at worst.
ed's right though--call the media, and SUE the Bast**d--i mean really: how much are you out..???
and the LESSON here is: get originals (or certified copies) of everything when it comes down to a "substantial" invstment (a dog or a mutual fund). right? there's NO EXCUSE for stupidity--i work 12 hrs/day, but even I get the jist of Judge Judy,etc: document, document, document.
it's a pain, but any place that is not willing to provide documentation, a person should RUN (not walk) away from. and i'm no different, i've found that when i get lazy, i get screwed (and not in a good way).
A simple question here! If the vet changed/filled out the papers AFTER they were signed, is this just a he said, she said scenario? Would calling the news media in that instance create an opening for a slander suit?
