I have a question. Did your dog have two incisions? In a normal neuter, there is one central incision just above the scrotum. If they had to go fishing for an undescended testicle, there would be a second incision in the groin area on whichever side the undescended nut was on. If there was only one incision either: (A) the testicle was able to be pressed down into the original incision and thus would probably have come down on it's own; or (B) they left the second testicle in there. "A" gives you the argument that he may have been acceptable for breeding in the future, "B" is just plain negligence. " Either way, I hope you have contacted a lawyer.
yes it is possible for testicle to descend up to 6 months or whenever the inguinal ring closes. Sounds like if the testicle was "in the ring" it wes on it's way down, or stuck there. I would report this vet to the veterinary board in your state, contact an attorney and call the vet office demanding every cent of your money back, I hope at least you didn't pay for the neuter surgury! I would be incensed. It is your decision to neuter YOUR dog, cryptorchid or not - not your know it all vet.
I just wanted to say thanks for all the advice and support. We are doing some more research and are going to contact a lawyer.
If anyone hears anything more about the testosterone let me know please?

I would sue the vet for another dog of the same quaility.
As long as you have proof you did not authorize the neuter i don't see how you could lose. i would sue for the price of a new dog, vet bills and court cost.

Results: Results suggest that the presence of circulating testosterone in aging sexually intact male dogs may slow the progression of cognitive impairment, at least among dogs that already have signs of mild impairment.
