You will find that people are fairly forgiving here. Dave and VanCamp hated each other yesterday and now they are having Easter dinner together this weekend. Just start fresh in another thread.
One point about this is there is little point in argueing the extreams. You can find a reason to support anything if you look long enough. It comes down to using common sense in this and all other areas.

Torre... The traditional legal education stresses formal law "codes on the books." But, legal realists and judicial behavioralists have found that what happens in "real life" is often very different.
Simply put, their findings have illustrated that legal findings are STRONGLY influenced by social norms.
Judges and juries make the call based on a number of factors that are not officially "written in the codes."
Once the danger is explained to the judicial decsion maker, and the fact that a "typical, average, or reasonable person" cannot accurately determine the mental state (intent) of a strange dog that is charging... these factors will be considered in addition to the law.
