It sounds like they may have covered their butts with this second contract, but it still seems like they are trying to pull a fast one.

Have you considered threatening to get the local news involved? Nobody likes to have a consumer protection reporter knocking on the door.

Yes, Lauren..We are now gathering all the edvidence we have in hand. Including those abousing emails from them. We contacted the local county advisor and we are waiting for their call back to have this case open.

We have placed a complain on few of the consumer protection websites. We have contact few lawyers about this matter.

We would like every one to hear about this. Even we will lose our money...we would like to make every penny worth ...Hoping that we are the last victim from their hand.

There are a number of issues in dispute here and there's no need for me to pick sides. My suggestion is do your homework and put yourself in a more favorable position. If you can get some free legal advice, great, but I wouldn't pay anything to an attorney. Your case is too small to spend any money for an attorney. You should consider filing a case in Small Claims Court; it'll cost you about $30. This is the exact kind of dispute these courts are designed for. The mere threat of some pending legal action can persuade most people to consider working out some agreement to avoid court appearances. You should be able to file a case in your county, or you may have to do it in Santa Cruz County. Check these sites for lots of help on filing and presenting small claims cases:

Check with the Santa Cruz County Court website and look for other small claims cases against your breeder. You could track down those other plaintiffs and see how their dispute was resolved.

THEY SAID THEY WERE TRYING TO SELL THIS DOG...BUT WHAT ABOUT THE LAST EMAIL I POSTED HERE ABOUT THE 72 HRS PICK UP OR ELSE THEY KEEP THE DOG???? THEY DID BREACHED THE CONTRACT SINCE THERE'S NO EXP. DATE OF SALE. IT ONLY STATED "MAY TAKE UP TO 4 MONTHS TO SELL" .....

If you still would be happy with the $800, I suggest asking them to put it in writing that you will receive the refund in either cash or a cashier's check (I personally would NOT accept a regular check from this group of clowns), and that once you have received the money you will post the solution they provided on My3Cents. I would not remove the post; it is the truth and obviously why they are negotiating with you at this point. If you agree to remove the post, I would certainly ONLY do so after being given cash or a cashier's check... Good luck.
