Greg, if you are going to take any legal action it would be unwise to keep airing your grief. If you are willing to work this out with them you could grant their request at least till you come to some kind of resolution. Otherwise be ready for them to counter sue. The plaintiff in Small Claims does not have appeal rights, the defendant does.
After an admittedly cursory reading of the contract and not being a legal expert by any means, it seems to me they really have the option, if they so choose, to provide you with another dog rather than the offered money.
Take your pick.
They are willing at this point to negotiate.
As to what's been posted here and other forums.....that is already out in the no-mans-land of the internet. You can do aught about it.
I have took the advise from all of you.
and have sent it to them as following:
1) You can mail the check or money order of Eight Hundred Dollard ($800.00)
2) The check/money order must mail with tracking number/return receipt.
3) Once the check is clear,we will stop this case going forward with Department of Justice and Small Claims Court in California.
4) We will get an addendum prepare ready to be sign per our agreement above and properly close this transaction with your organization.
Thank you,
------------
If you read their email they are asking us to REMOVE the post first since there is a POTENTIAL BUYER. I must be really careful..
They just email me that they have mail the check out. It will be personal check of $800.00.
Thank you all for all these valuable advise. I am glad you guys are here to witness this issue and also able to provide opinions fairly as a 3rd party.
I have always wanted this to end in peaceful, fair way.
In a way,I paid for the mistake I have made not being careful enough. I surely learn my lesson.
God bless you all and have a great life with your lovely shepherd beside you.
Deposit the check and make sure it CLEARS before you celebrate or revise any info on the internet. Hopefully this will be the end to a hard-learned lesson... we've all been there at one time or another. Good luck.
Yes,Barbara..Thanks again for this friendly reminder.
