For those interested in California Assembly Bill AB1634, this e-mail was passed on to me this morning.

A permitted protest against AB1634 will take place on May 16,come if you can! Parade permit received for outside in Area 27. Bring your dogs. No decorations to be hung on state property.

We are permitted to gather at the state capitol, May 16th. Forward this to as many NO on AB1634 persons as you wish. Wear orange vests, hats, ribbons etc. if you have them.

We will be permitted for Area 27 on the grounds,(we are checking but think it is the East side of the Capitol grounds) from 8AM or earlier until 2PM. I will have orange tape outlining the area.

We are permitted for dogs on leash, a PA system, flyers, posters, and tables. NO alcohol please. Make sure your dogs are friendly if you bring them:-)

Wednesday the 16th is when it is scheduled. Kinda strange though the website says the assembly is adjourned till thursday.

There is something wrong with AB 1634!!! I don’t mean the obvious that it’s invasive overly restrictive and ill-conceived I mean there must be a typo. If I am correct and there is a typographical error the bill isn’t actually so bad. Of course that would depend on the permit application and fee structure.

The reason I say this is if you look at 122336.2(a) (Bill provided below for reference) in the second line it says…”if all of the following conditions are met:” This should say “if any of the following conditions are met:” the reason this must be is that if it is in the conjunctive then the only dogs capable of receiving an unaltered permit under AB1634 are dogs that;
(tracking bill)
(1) Are registered; AND
(2) Appropriately trained and meet the definition of guide, service or signal dog; AND
(3) Appropriately trained (again) actively used by law enforcement; AND
(4) Must have a letter from the Vet saying it is too sick or old to be altered.

So if we read AB1634 the way it appears, the only dog (and this would exclude all cats) that can secure a permit to remain unaltered is a: Really sick or old purebred, registered, trained guide or service dog that happens to work for a police department on the side.

Such a law would not pass constitutional muster and would probably violate the equal protection clause as it is not rationally related to a compelling governmental interest.

Additionally the inclusion of The International Cat Association in subsection(1)(E) confirms it is “any” of the conditions not “all” the conditions unless the Police Departments in California employ attack cats. And while I would never make fun of blind people someone attempting to utilize a “seeing-eye” cat would have comedic value…..

So in closing, if the bill is one of “any” and not “all” then it is a good law for those of us who are responsible. However, we better make sure we use our energy (at least in CA) making sure the permit and fee structure is not punitive or prohibitive ($500.00 per year per dog). Everybody else should keep in mind that as California passes wacko laws the rest of the nation follows suit.

I would love to hear another view point, if you rationally review my hypothesis.

122336.2. (a) A local jurisdiction shall issue an intact permit,
as defined in subdivision (b) of Section 122336, if all of the
following conditions are met:
(1) The cat or dog is registered as a purebred with a pedigree
with any of the following organizations:
(A) The American Kennel Club.
(B) The United Kennel Club.
(C) The American Dog Breeders Association.
(D) The International Cat Association.
(E) A recognized registry approved by the local animal control
agency.
(2) The dog is appropriately trained and meets the definition of
guide dog, service dog, or signal dog, as set forth in subdivisions
(d), (e), and (f) of Section 365.5 of the Penal Code.
(3) The dog is documented as having been appropriately trained and
actively used by law enforcement agencies for law enforcement and
rescue activities.
(4) The owner of a cat or dog provides a letter to the local
jurisdiction from a California licensed veterinarian stating that due
to age, poor health, or illness, it is unsafe to spay or neuter the
cat or dog. This letter shall include the veterinarian's license
number and shall be provided, upon request, to the local animal
control agency.
(b) An unaltered cat or dog for which an intact permit was issued
who ceases to meet the requirements of subdivision (a) is subject to
the spay and neuter requirements set forth in Section 122336.1.
(c) The amount of the fee for an intact permit shall be determined
by the local jurisdiction, and shall be no more than what is
reasonably necessary to fund the administration of that jurisdiction'
