But how does the dog know the person is there to commit a crime? A dog can't tell the difference between a contractor, meter reader or neighbor who is allowed to come in unasked from a thief. It's the owner who must determine the degree of danger and take appropriate measures to make sure their dog is contained safely. I guess I wouldn't be very good in a job like yours. I believe most dog bites are handler/owner error. I wouldn't call very many dogs dangerous but I would call a lot of owners names that would probably get me kicked off this website and whatever committee I was on.
The fact that it is natural instinct for a dog to have territorial aggression was not lost on those who drafted the parameters of the ordinance. Your unwanted presence on someone elses' property is a crime...trespassing. And depending on how access was gained onto said property, burglary. This takes the dog out of the equation on using human cognitive powers to justify its' actions. After all, we know dogs aren't lawyers....although some lawyers think like dogs :-)
