This is the only place I could fine to place this subject. If I sell a puppy to someone and that dog
grows up and bites someone or a child and goes to court. What legal responsibility falls on the
breeder? Does anyone know if the breeder gets notified or called into court on these typ of cases?
Can the breeder be sued as well?
Anybody can be sued for anything.....but can they win? I think that your risk would be low, in order to win on something like that it would have to be shown that you were negligent in the breeding of the dogs. For instance if 6/10 puppies from a previous breeding of the same dogs had to be put down for being viscous, and the breeding was repeated, you may have some limited exposure.
I would think that it would be very difficult to demonstrate that you were negligent in the breeding or sale of a dog. It would take something outragous. If you sold a puppy to someone that stated they were a drug dealer, and they wanted the dog for protection from the police (they would have to say all of that) or wanted a dog to be viscious, you may have some problems. I think that it would take that level of negligence on your part.
Now that I think about it, the questionaire that many breeders are requesting prior to selling a puppy may be a good idea for just this reason. With answered questionaire, you have a written responses from the buyer as to their level of experience, intentions for the puppy, and access to a good trainer and a Vet. If you kept that on file with information about the litter I think it might create a significant resource for a defence if someone did try and sue you over a puppy.

In the case in Calif. the name of the breeder of the Presas was definitely brought in the public eye. It was a breeder nolonger in business. I'm sure if that breeder were still around, life would become more difficult with local residents. When a dog bites someone, I think that the news people look for any angle. Probably being sued would not be your only concern.
