This ties in with our current SchH Club "project". We currently insure w/Sportsman's, as we understand most clubs do. The premium is high with no bite coverage, we understand this would be available at a much higher premium (another member inquiring about this). So can a club form a LLC? Something maybe we should look into? And would this make insurance more available/comprehensive for the same money?
Unincorperated associations which sounds like your club are generally governed by the Uniform Unicorperated Nonprofit Association Act (if your state has adopted it). Every state's law is different you will need to check with your local attorney.
Generally a nonprofit association is a seperate legal enitiy from its members for purpose of tort liability.The association not the individual members are liable for the negligence of employees or officers acting in the course and scope of employment.
