Something tells me that a class action lawsuit is coming involving pitbulls, the federal government, and breed bans. I don't know what it is, but it's coming.
The federal government put out a statement that no one, not even the state, can discriminate against the BREED of dog someone is using as a service/assistance animal. The specifically named certain breeds that the public was whining about.
I'm not sure what to think. The poor dog, or what the f is wrong with the owner that they don't know ADA laws.
I am so sick of BSL cr*p! I sent an email to the address they give for applications telling them they're violating federal law and to return to dog to its owner so the dog can do its job.
Probably won't do any good but at least I feel a bit better for trying to do something.
Elaine, thanks for the help, but if you could, can you write the City of Sioux City and tell them the same thing? Sioux Falls (the town that has the dog) doesn't have breed bans but they are the nearest shelter that would take a pittie.
A part of me is really angry that the owners would check BSL before moving to a new town with a bully breed but I am absolutely livid that they would force a service dog out of the town.
Federal law trumps town/city ordinances, and it is illegal for a town/city to disallow a service dog of any breed. There was a similar issue in Ohio (I think?) just recently and it resulted in the fellow getting his dog back and a law suit against the town. It is my hope that other who are similarly discriminated against will put up a similar fight instead of caving in to a pointless, senseless (and in this case, toothless) ordinance. The ADA is adamantly clear on this point. BSL is irrelevant as far as federal law is concerned.
The folks who dumped this poor guy should have looked into the laws a little more closely.
This seems a bit fishy to me. Seriously, you train a dog as an assistance dog for two years then you just place him in an animal shelter??? no breed rescue? No service dog organization?
It makes me wonder if they really know what they're doing...
