fault does matter as if police get hold of it one dog has to be aggressive - the GSD's life could well be in my hands legally. i have fed the thing several times n would find it hard to order its destruction, its just a really disturbed dog.
If it is a deeply disturbed dog, what kind of quality of life does it have? It sounds like the dog is a ticking time bomb, The owner is apathetic and it is only a matter of time before another dog gets killed. And seriously, what is going to happen if the dog gets loose and a child is walking a dog down the road or something like that?
You hate to see an otherwise healthy animal put down, but the consequences of it continuing to live in this manner could be pretty devastating

my dog is real athletic n she turned while GSD was still attached and nailed him right on the top of the shoulders he let go n she transferred to his neck n shook the crap out of him by the time i got their GSD was screaming on it back. so now two dogs at vet the GSD can't move its front leg from the shoulder bite.
as far as neigbour is concerned there was no attack as the GSD left my yard before the neighbour knew anything, he only saw his dog at his house - what attack - prove it was his dog that bit mine!!!
Half a brain cell would say the presumption of evidence proves it was his dog.
Seriously though, cool story bro.

what sort of life does the GSD have; excellent nutrition/health care, big back yard. no formal training ever, noone to ever play with, minimal contact with people, never leaves property ever - not counting escapes. purchased as a yard protector, basically left to itself n does protect.
"Half a brain cell would say the presumption of evidence proves it was his dog" - er n what has the obvious ever had to do with legal proceedings, its not what you know its what you can prove. i am the only one that saw what happened n that doesn't count for crap.we only have sketchy documentation from previous cases and a lot of angry neghbours wanting an excuse. fortunately the neighbours love my dog n the local AC lady who is also my agility trainer n the president of the local kennel club have all known my pup since puppy-school n at least 2 twice a week since n will vouch for her. matters with police now anyways.

no money to report, the whole crap that follows between the warring parties usually costs. AC are way over-stretched in their resources n budget, we have a puupy-mill problem here two biggest busts in out history, it atkes evry resource n months of work to get a conviction. then the courst ace starts, usually the guilt are back breeding again in no time n AC are left with hundreds of dogs to re-home.
so have to consider those indirect costs before whinging about smaller problems relatively speaking.

Taking your dog to the vet every time it gets bit gets costly too.
Not to mention the apparently dangerous dog who attacks people, possibly attacking someone's kid.
To answer your question re: who is at fault.
Generally, the person who doesn't call is at fault, since failing to report makes you look guilty.

haha thats funny becuase the one who did the reporting was the GSD owners wife - what did she report - nothing about a dog fight but reported excess barking, n the fact that she feels threatened by my dog.
shes smart, smarter than me anyway. the husband thinks its just another nightmare he has to endure re this dog. he would way prefer to not have any dog at all but the guy is clearly whipped.

Geez Peter, your “story” sounded realistic?
Clearly the vet has records to prove it wasn’t simply “dogs barking”.
And a woman calling the authorities with a falsified report is “clearly smarter than you”. Begs another question, but I’ll leave that one alone.
Something doesn’t sound right. You had me quite concerned about your situation. I’m now thinking that may have been somewhat misplaced.
