Ouch an out of Stae defendant. This can get VERY complicated but if she has enough "minimum contacts" with the state of New Hampshire you can get a judgment against her then try to collect it in California. The jurisdiction fight alone could run many thousands of dollars.
Anyway she will have to hire a lawyer too and that will cost her more than 2600 maybe that fact will get her to do right by you.
As an aside, usually if people are not willing to give your money back it is because they have already spent it and really do not have any recoverable assets. Put simply, you could spend all this money and time and still not recover anything. Hence the adage "you cannot get blood out of a turnip", but then again as my Dad you to say "no you can't get blood out of a turnip but you can sure squeeze the s#&t out of one".
Anyway what kennel are you getting your new pup from?
Disclaimer- I am not an attorney and this isn't legal advice. But if you have no contract and there was no discussion of what dog you were getting it seems like this would be a difficult case to win. She could say she thought you sent the money to support retired showdogs in their old age <img src="/ubbthreads/images/graemlins/laugh.gif" alt="" /> .
Terri,
It is very unfortunate that there are breeders in this great world of dogs that would prey on trusting people like yourself. I really hope you get your money back. However, if you don't, use every forum possible to get your 2600.00 worth of satisfaction. Make sure you let that breeder from hell know where she and everyone else will find your comments.
