Cathy : well those of us that have done rescue in one way or another ,know the trails and tribulations that people go through over the years . IMHO its the rescue service problem here in the first place by placeing a intact female with a home that has an intact male . The female is a ward of the rescue service , and did you not know that she had been bred till it was to late to do some thing about it .Is this not in the claus for the foster homes to sign ,or was this just an over sight from the rescue service ? I could not display all the posts ,so i am shotting in the dark here . Is the foster home wanting to keep the pups ? ,or are the rescue service wanting to take and place the pups ? Or what kind of agreement are you trying to work ?
I would think the pups belong to the owner of the female . Peter
Yikes - how awful. What does the foster contract say, or did they have one? Some purebred rescue contracts I have seen state:
"Neutering. Fostering Party agrees that under no circumstances will this dog be used for breeding purposes if not neutered/spayed before placement in foster home with Fostering Party. Fostering Party agrees to keep females in heat away from male dogs and to accept full responsibility for any puppies resulting from any such union with Rescue dog."
Which would mean pups are sole responsibility of the foster home. Depends on what they agreed on. I am sad they placed an intact dog in a home with an intact dog of the opposite sex. Many of us have made mistakes with foster homes we have trusted, often in desperation to save dogs and NOT resulting in more dogs, but this is so sad.
