The fact that these people did not protect the public from these dogs is not what is getting them a "2nd degree murder" charge. It was the intended use of the dog that resulted in the death of the neighbor that is gonna get her fried. (with any luck) The state is going to have to prove that the intent at the time of the killing warrants a conviction of 2nd degree murder. If they don't do it then it will be a question of negligence and she could be convicted of a lesser charge.

This is one reason that many people will not admit that their dogs are bite trained. Your Sch trained dog is not considered lethal as it is trained to bite and hold and has been trained to out.Obviously the intent is not to kill but control. Look at that Dog Bite Law site. It is very interesting.

Noeller got 2nd degree after her grand jury testimony, which is still sealed, I believe. There has to be a finding of malice for murder to stick, I believe.
Van Camp, I agree about your wish for Noeller's fate, but we don't fry people in California for 2nd degree murder. Well, we don't fry them at all, and don't kill them often enough.
Looking at the parade of killers in the news, I can only say, with Arnaud Amaury, Abbot of Citeaux: "Kill them all, God will know his own."

BTW, on a totally different subject, is anyone else on this board enjoying the symbolism of keeping the terrorist prisoners at Gitmo in what amount to dog kennels? Moslems generally abhor dogs; they are one of five unclean animals. (I believe they excepted the Saluki.)

These people are sick. They defend this criminal and he goes to prison so they decide to take care of his insane dogs. Not only that but they adopted this guy??? They found all kinds of drawings in this guys cell of presa's killing people and other animals. The Noeller idiots tried to blame the girls death on her perfume. They said the girl wore too much perfume and it irritated their dogs, that is why they killed her.
I think we all agree that these people are sick and disgusting. The question is, is this murder in a legal sense? I'm curious to see what the jury decides.
As for the perfume, I think what they contended was that the pheremones in her perfume sent the dogs into a frenzy, not that she wore too much. Am I wrong? I should go back to that website and read up some more, I guess, as some of the details are still beyond me.

Milt, I hear ya, but I think that in a case like this, that the right thing to do would be for the defendants to cop a plea. The fact that they are fighting this and haven't shown any remorse is what really disgusts me the most about their behavior.
